Hunt: The Court has reviewed Plaintiff's initial status report 19 and Plaintiff's Ex Parte Motion for Entry of a Temporary Restraining Order, Including a Temporary Injunction, A Temporary Asset Restraint, Expedited Discovery, and Service of Process by Email and/or Electronic Publication 14. Plaintiff commenced this action on 9/19/24 and filed an amended complaint and amended Schedule A on 9/24/24 but failed to take any further action until after the Court entered an order on 10/17/24 12 unsealing all documents and setting initial status dates. Due to this delay and because Defendant's identity is not under seal, Plaintiff's basis for seeking an ex parte TRO no longer exists. See Fed. R. Civ. P. 65(b)(1). As such, the ex parte motion 14 is denied and the motion to exceed page limitation 13 is denied as moot. Furthermore, Plaintiff did not obtain Court approval to file documents under seal; accordingly, the Clerk is directed to unseal 16, forthwith. At this point, the case has been sitting for two months. Plaintiff should focus its efforts on effectuating service of the summons and complaint to move the litigation forward. To that end, by 11/25/24, Plaintiff is directed to add defendant TrustKK_LLC to the docket and to terminate "The Partnerships and Unincorporated Associations Identified on Schedule "A" as the defendant. Finally, Plaintiff may renew any request for expedited third-party discovery to identify defendant and/or for alternative service. And after obtaining defendant's contact information, Plaintiff may file a properly noticed motion for entry of a preliminary injunction or other appropriate relief.
