Tharp, Jr: Upon review of Plaintiff's Supplement to its motion for temporary restraining order 21, the Court recommends to the Executive Committee that this case be returned to the calendar of Judge Cummings pursuant to Local Rule 40.3. Plaintiff's supplement candidly acknowledges that the defendants in this suit were all named in a previously filed action (24 cv 8409) but were dropped from that case because Plaintiff's counsel anticipated that the assigned judge would not approve joinder of the 116 defendants named in the original complaint in that case. To avoid that result, Plaintiff named all but one of the original defendants in 24-cv-8409 as defendants in this action, which is substantively identical to 24-cv-8409. Pursuant to LR 40.3, this actioneffectively involving defendants that were voluntarily dismissed from 24-cv-8409should therefore have been directly assigned to Judge Cummings.
