Tharp, Jr: Upon review of the plaintiff's supplemental memorandum 17 in response to the Court's 5/7/2025 order 14, the Court finds joinder of the 24 previously-named defendants improper. As such, this scenario smacks of forum shopping: filing a claim, anticipating an adverse ruling, and then filing a new suit that presents the same claim before a different judge. To remedy this problem, this Court will limit joinder in this case to a maximum of one of the original 24 defendants and the seven new defendants. If the plaintiff wishes to pursue its claims against the remaining 23 defendants originally named in Judge Gottschall's case, it must file another suit, with a complete civil cover sheet that accurately notes the history of the defendants who were originally named in 25-3976.
