Citation proceedings can be terminated by order of court, IL S.Ct. Rule 277(f), and respondents' motion asks for an order. Plaintiff (Judgment Creditor) argues that the citation respondents haven't submitted facts to show that they are not holding the debtors' assets, but the burden is on plaintiff/creditor to show that the citation respondents are holding debtors' assets. See Door Props., LLC v. Nahlawi, 2020 IL App (1st) 173163, 31 ("It is the judgment creditor's burden of showing that the third-party respondent possesses assets of the judgment debtor."). Plaintiff has had years to get to the bottom of this case. More recently, judgment entered in May 2024, and citation respondents sat for a deposition in December 2024. If plaintiff cannot prove now that respondents are holding debtors' assets, plaintiff will never prove it. In response to the motion, plaintiff offers no basis to believe that respondents hold debtors' assets. The citations to ContextLogic and Wish US Holdings are dismissed, and the clerk shall terminate ContextLogic and Wish as garnishees along with the appearances of their counsel from the docket. The court exercises its discretion to decline to tax any costs in connection with these citation proceedings. Both sides have run up costs in connection with a relatively small judgment and, as a result, each side bearing its own costs is an appropriate burden. Notices Mailed. 翻译

The names, funnytrump, poppyhenler, and boomboom123 are not parties to this action and no further court action is necessary to establish that point. To the extent the asset freeze is improperly restraining the assets of anyone, the owner of those assets may file a motion explaining why those assets are not subject to the terms of the injunction, but there is no need to dismiss or confirm dismissal of names that are not parties to the case. The motion to strike or for judgment on the pleadings 257 is denied. Some of defendants' assertions in its pleadings are likely moot or without basis because there are no trademark claims in the operative complaint (238). But their presence causes no prejudice to plaintiff, so striking them would not materially advance the litigation. Defendants' boilerplate affirmative defenses, including assertions that are not defenses but denials of liability, similarly cause no prejudice to plaintiff because litigation on the merits of plaintiff's claims will necessarily resolve those issues. Whether defendants are entitled to attorneys' fees will be resolved after the prevailing party status (and on what claims) is determined. Judgment on the pleadings is not appropriate because there remain contested facts on the merits of plaintiff's claims and the partial issues on which plaintiff seeks judgment on the pleadings require factual development to resolve. To the extent plaintiff seeks judgment on the pleadings for the same reasons it seeks to strike allegations, the request is denied for the same reasons -- the unnecessary or boilerplate assertions are doing no work in the case and causing no confusion or prejudice to plaintiff. The motion to terminate citation proceedings 288 is granted in part, and denied in part. The motion is granted in part as to the citation proceedings against ContextLogic/Wish.com. Plaintiff confirms that it is not pursuing the citation against Wish.com and does not object to an order terminating citation proceedings against Wish.com. 300 at 2. The motion is denied as to its request for clarification of the preliminary injunction. The preliminary injunction has not been vacated and its terms are clear. No clarification is necessary. Kocoras: It has been brought to the Court's attention that the Default Judgment Order as to Defendants Jing Zhang, Ming Jie Guo, and Xiao Jie Zhong ("Defaulted Defendants") 262 inadvertently contained language referencing internet stores Funnytrump, Poppyhenler, and BoomBoom123 ("Internet Stores"). The Court previously ruled that Plaintiff had not shown the Defaulted Defendants were the owners or sole proprietors of the Internet Stores 235, and Plaintiff's Motion for Default Judgment still did not do so. As evidence that the Defaulted Defendants are the owners or sole proprietors of the Internet stores, Plaintiff cited a spreadsheet prepared by Wish.com, which lists the Defaulted Defendants as the "Merchant Real Person Name" for the respective Internet Stores. Dkt. # 70. But this does not show ownership. Even if the Defaulted Defendants were somehow associated with or working with the Internet Stores, and were the ones to register the Internet Stores with Wish.com, that does not confer personal liability. The only other documents Plaintiff cited are Dkt. # 223-2, Dkt. # 223-3, and Dkt. # 223-4. These declarations at most show that the Defaulted Defendants were a business liaison, general manager, chairman of the board, shareholder, legal representative, or executive director of the respective Internet Store, but, again, not the owner or sole proprietor. The Defaulted Defendants are at most "associated with" the Internet Stores, but do not appear to own them or to be their sole proprietors, and we therefore have no basis on which to hold them liable to Plaintiff for the damages requested. The Default Judgment Order 262 is vacated. To the extent this order affects Plaintiff's response to motion to dismiss 241, Plaintiff may file a sur-reply by 10/24/2023. 翻译

By 3/22/2022, defendant to provide redacted copies of the emails numbered 188, 191, 192, and 197 (redacting the content of the emails but not the To, From and Subject lines) to Plaintiff, and provide the Court with certified Chinese language translations of these same emails for in camera review. As for disputes raised in the 3/2/2022 joint status report, the Court finds that Defendant is entitled to depose plaintiff and plaintiff's representative now that Plaintiff has tendered supplemental responses to written discovery as ordered. Defendants requested to defer these depositions until after the filing of dispositive motions as a cost-saving measure. Plaintiff indicated support for this approach and also indicated that, in the event dispositive motions were to be denied, Plaintiff would seek to depose additional witnesses and possibly issue further written discovery before trial. For reasons stated on the record, the Court grants in part and denies in part Defendants' motion to compel 174 as follows: (1) regarding Plaintiff's answers to the First Set of Interrogatories and First Set of Requests for Production from Defendants Garment Outlets, Trendyshow, Fashionforgirls, Qian Ni Trade, Beautyfactory, Daisy Xie and Vivi Fang, the motion is: (a) denied as moot as to Interrogatories 1,3, 7-4 based on the third supplemental answers provided on 2/1/2022 (Doc. 182-1); (b) denied as moot as to RFPs 10, 45, and 51-54 based on the supplemental answers provided on 1/18/2022 (Doc. 180-3); and (c) denied as to RFP 22 but Plaintiff must provide a supplemental answer if settlement agreements were withheld (the answer says no documents are being withheld based on the foregoing objections); (2) regarding Plaintiff's answers to the First Set of Interrogatories and First Set of Requests for Production from Defendants Funnytrump, Poppyhenler, BoomBoom123, the motion is (a) granted in part as to Interrogatories 1, 3, 7-14 in that Plaintiff must provide supplemental answers that are both verified and that describe with specificity the location of responsive information within voluminous documents referenced in the answers; and (b) denied as to RFPs 25, 26, 28. Plaintiff's supplemental answers are due by 3/2/2022. As for Plaintiff's argument that Defendants' First Supplemental privilege log lacks sufficient detail and so the privilege is waived [Doc. 168-2], the Court finds for reasons stated on the record that log entries 1-185 are sufficiently detailed and no waiver has occurred, but will conduct an in camera review of the materials identified in log entries 186-197. Defendants are to provide these materials by 2/28/2022. They may be emailed to chambers_finnegan@ilnd.uscourts.gov or tendered in another manner. As for depositions and other discovery, the parties are to confer and file a joint status report by 3/2/2022 regarding any remaining discovery, a proposed deadline to complete it, and any other case management issues that they wish to raise.
