Brown, 787 F.3d 851, 857 (7th Cir. 2015) (citation omitted). The proper way to drop fewer than all defendants is to amend the complaint in accordance with Fed. R. Civ. P. 15(a). See id. at 757-58. Under this authority, plaintiff's notice of voluntary dismissal (No. 52) is ineffective. Although plaintiff requests a preliminary injunction prohibiting defendants from further infringing its trademark, plaintiff's proposed form of preliminary injunction emailed on May 6, 2021, contains no language prohibiting infringement. The order will be entered in the form plaintiff proposes. The court rejects plaintiff's argument that continuing the asset freeze imposed by the temporary restraining order can be justified as a means of preserving plaintiff's right to collect any money damages it may eventually obtain. See Grupo Mexicano de Desarrollo, S.A. v. Alliance Bond Fund, Inc., 527 U.S. 308, 333 (1999). Evidence in the record shows that plaintiff has not obtained sales data for all defendants, despite diligently pursuing discovery authorized by the temporary restraining order. See Decl. of Theodore J. Chiacchio ¶¶ 4-6, ECF No. 43. Based on that evidence, extending the asset freeze remains necessary to protect plaintiff's right to an equitable accounting. See CSC Holdings, Inc. v. Redisi, 309 F.3d 988, 996 (7th Cir. 2002). Plaintiff's renewed motion (ECF No. 40) for preliminary injunction is granted. Enter order. Because plaintiff has obtained a preliminary injunction, there appears to be no further reason to maintain documents under seal. Unless plaintiff advises the court by May 19, 2021, that releasing the seal is opposed, all documents previously filed under seal in this case will be unsealed.
